1. Acceptance of Terms

By accessing or using Gemly Studio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Gemly Studio is an AI-powered jewellery photography tool that transforms user-uploaded photos into professional product images. The Service is provided on an "as is" and "as available" basis.

3. Accounts

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Subscriptions and Payments

• The free tier (Quartz) provides 3 lifetime generations at no cost.
• Paid plans (Opal, Sapphire, Diamond) are billed monthly through Stripe.
• Generation allowances reset each billing cycle.
• You may cancel your subscription at any time by contacting us at gemlystudio@outlook.com. Access continues until the end of your current billing period.
• Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error.

5. User Content

• You retain all rights to the photos you upload and the images generated by the Service.
• By uploading photos, you confirm that you have the right to use those photos and that they do not infringe on any third party's rights.
• You grant Gemly Studio a limited license to process your uploaded photos solely for the purpose of providing the Service.
• Generated images may be used for any lawful commercial or personal purpose, including product listings on Etsy, Amazon, Shopify, and social media.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content that is illegal, harmful, or infringes on others' rights.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or prompts.
• Resell access to the Service without written permission.
• Use automated tools to access the Service in a manner that exceeds reasonable use.

7. Intellectual Property

The Gemly Studio name, logo, website design, and underlying technology are the property of Gemly Studio. Nothing in these terms grants you any right to use our branding or technology beyond normal use of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Gemly Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. AI-Generated Content Disclaimer

Images generated by Gemly Studio are produced using artificial intelligence. While we strive for accuracy in preserving your jewellery's appearance, AI-generated images may contain minor variations or imperfections. You are responsible for reviewing all generated images before using them commercially.

10. Modifications

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will make reasonable efforts to notify users of significant changes.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us.
